I have a particular interest in status or ‘gig economy’ claims, following the cases of Pimlico Plumbers, Uber, Deliveroo, City Spring and others. In these, workers claim they are “limb (b) workers”, self-employed individuals entitled to basic rights such as paid holidays, the minimum wage, and protection from discrimination.
How my background makes a difference
My commercial experience, prior to qualifying as a lawyer, is invaluable in assessing witnesses, the plausibility of their narratives, and the relative seriousness of an allegation. My work experience also helps me to build a rapport with interviewees. In my youth, I worked in a coleslaw factory, drove a forklift truck, and manned a trade counter. Later, as a money market trader, I mixed with people handling millions of financial products every day. And I’ve sat alongside QCs and High Court Judges at Inns of Court dinners. I am well used to adjusting my style and approach.
As an experienced decision maker, I can envisage the likely arguments in a hearing and make an impartial and robust appraisal of evidence. My informed assessment enables clients to develop a more targeted and secure strategy.
My independence also minimises the risk of the cognitive bias which can blind the employer or employee to crucial evidence. This evidence will almost certainly come out at a hearing or trial if not properly developed during the investigation.
Where I can help
I can act for employers and employees, on a direct access basis or through a solicitor, before Employment Tribunals and the Employment Appeal Tribunal. I am also experienced in helping to negotiate settlement agreements and acting as a mediator for ongoing relationships.
I am able to provide the required ‘Independent Settlement Agreement Advice‘ which the law requires for a settlement agreement between an employee and employer to be binding. I can normally provide this advice within 24 hours for a fixed fee paid by the employer.
Past cases
I have dealt with employment matters for some of the UK’s largest and highest profile companies and organisations with particular experience of academic, healthcare, technology, financial services, and construction industries.
The allegations or complaints I have dealt with include:
- sexual misconduct, sexual harassment, and obscene imagery of sexual violence
- exposing the organisation to multimillion pound risk and reputational damage
- risking the loss of major contract representing 25% of business unit income
- bullying and harassment, including at Board/CEO level
- practising witchcraft in the workplace and putting curses on colleagues
- running a business from employer’s premises
- misconduct flowing from mental health issues and addictions
- unauthorised leaks to the press
- bringing the employer into disrepute
- covert recordings of Board/CEO meetings
- whistle-blowing
- unfair grievance proceedings
- breach of trust and confidence
